Participant Liability Waiver & Terms of Entry 

1. Assumption of Risk 

Participant understands and acknowledges that participation in a drive-thru light show involves certain inherent risks, including but not limited to: visual stimulation (e.g., flashing lights, fog, music), low visibility, environmental conditions, interaction with other vehicles, and potential hazards related to the use of a motor vehicle on private property. 

By entering the Event premises, Participant voluntarily assumes all risks of personal injury, property damage, or other loss arising from or related to attendance at the Event, whether such risks are known or unknown, foreseeable or unforeseeable. 

2. Release and Waiver of Liability 

To the fullest extent permitted by law, Participant hereby releases, waives, discharges, and covenants not to sue the Event organizers, affiliates, owners, sponsors, employees, contractors, agents, volunteers, the owner and/or operator of the property where the Event is held, and all related entities or personnel (collectively, the "Released Parties") from any and all liability, claims, demands, actions, or causes of action for any injury, loss, or damage to person or property sustained before, during, or after participation in the Event, whether caused by negligence or otherwise. 

This release is intended to be as broad and inclusive as permitted by applicable law. 

3. Compliance with Laws and Event Rules 

Participant agrees to operate their vehicle in a safe, responsible manner and to comply with all applicable local, state, and federal traffic laws while entering, exiting, or driving within the Event grounds. 

Participant further agrees to follow all instructions provided by Event staff, signage, and volunteers during the Event, and understands that failure to do so may result in denial of entry or immediate removal from the premises without refund. 

4. Conduct and Behavior 

To maintain a safe and enjoyable environment for all guests, Participant agrees to refrain from disruptive, unsafe, or disorderly conduct, including but not limited to: exiting the vehicle, use of external sound systems, throwing items from the vehicle, or interfering with staff or other guests. Participant agrees not to use any item, accessory, costume, or Party Pack Item in a manner that obstructs the driver's vision or interferes with the safe operation of the vehicle.

5. Media Release 

Participant grants the Event organizers and their partners the irrevocable right to use any photographs, video, or audio recordings taken during the Event, which may include the Participant's likeness, voice, or vehicle, for promotional, advertising, and archival purposes, without compensation or additional consent. 

6. Personal Property Disclaimer 

The Event organizers and the Released Parties are not responsible for any lost, stolen, or damaged personal property, including items left inside vehicles or merchandise purchased at the Event. 

6A. Party Pack Items

Participants who purchase or receive a Party Pack acknowledge that it may contain novelty and light-up items, including but not limited to: LED light sticks, LED light wristbands, a Believe Bell, mistletoe, bracelets, and novelty glasses (collectively, the "Party Pack Items").

Participant assumes all risks associated with the possession and use of Party Pack Items. Participant agrees that Party Pack Items will be used only as intended and in a safe manner. Drivers are prohibited from using or wearing any Party Pack Item that may obstruct vision, impair concentration, distract from the operation of a motor vehicle, or otherwise create an unsafe condition while driving.

Parents and guardians are solely responsible for supervising children in their vehicle and ensuring Party Pack Items are used safely. The Released Parties shall not be liable for any injury, illness, allergic reaction, property damage, loss, theft, misuse, or other claim arising from or related to the use, possession, or distribution of Party Pack Items.

7. Force Majeure and Event Cancellation 

This is a rain-or-shine event. However, in the event of cancellation or rescheduling due to weather, safety concerns, acts

of God, or other circumstances beyond the organizers' reasonable control, the Event reserves the right to reschedule, relocate, or cancel without obligation for additional compensation. Any refund or reschedule policies will be communicated to the email provided at the time of purchase. 

Final Acknowledgment 

By attending the Event, Participant confirms they have read, understood, and agreed to the above terms in full. If you do not consent to these terms, please contact us within 24 hours of purchase.
